Data on Track 1 records cases, fiscal year 2026

This request asks for an extract of existing data from FIRST, the system USCIS uses to track records requests, for every case about agency records (not a person's immigration file) received since October 1, 2025 that was placed in Track 1, USCIS's simple processing track, at any point. It lists the specific fields wanted, such as dates, office and track changes, and final action.

Why it matters
The data would show how cases in the simple track were handled over time.

The closure and the appeal

Appeal IRW-111-AP · filed Oct 6, 2026 · Pending decision

Why USCIS closed the request

USCIS closed the request, claiming it did not follow its request rules (6 C.F.R. 5.3). The letter said the "subject of record's" date of birth was not provided, and that the signature was "unacceptable" for one of four listed reasons, without saying which one. It closed the request five calendar days after the receipt date it states.

What the rules say

USCIS's identity rules apply to requests for records about a person: the requester (6 C.F.R. 5.3(a)(3)) or someone else (6 C.F.R. 5.3(a)(4)). The identity details and signature the letter asked for come from the rule for people seeking their own records (6 C.F.R. 5.21(e)). This request asked for agency records about how USCIS works, not records about a person, so those rules do not apply to it.

Why it was appealed

The appeal argues that identity verification applies only to requests for records about a person (6 C.F.R. 5.3(a)(3) and (a)(4)), and the request said on its face that identity verification did not apply to it. It also points out that the letter did not say which signature problem it found, and that FOIA lets an agency ask a requester once for missing information and pause the clock, rather than close the request. It asks USCIS to reverse the closure, reopen the request and keep its original receipt date. It also asks USCIS to contact the requester before any further closure.

The closure and appeal sections summarize the letter and the appeal as filed. "What the rules say" is this site's explanation.
